The tech sector has thrown its support behind the Coalition's consideration of a "patent box" tax cut, designed to incentivise the commercialisation of intellectual property, but not at the expense of research and development tax incentives. "We should do both. I believe that Australia should spend 3-4 per cent of GDP on R&D rather than the 2 per cent we do now, given how unsophisticated our economy is (we rank 77th in the Harvard Economic Complexity Index)," he said. "Australia needs to operate on a level playing field regarding taxes in order to retain companies as they get larger and move into profitability and to attract large technology companies to the country for R&D. In the UK, the company tax rate is already substantially lower than in Australia, with companies paying just 20 per cent. Mr Barrie said the government was capable of reforming the R&D incentives to prevent businesses from abusing the scheme and better preventing ordinary business costs being claimed as R&D , but admitted that implementing the patent box tax cuts would prevent these issues. "The patent box structure addresses the issues the government had with the R&D tax incentives not being used for commercialisation of intellectual property," he said. "Most importantly we need incentives to encourage growth stage technology companies. These companies are the ones that drive employment growth." While users of Britain's patent box are split evenly in size between big, medium, small and micro businesses, the majority of monetary relief by value went to the largest companies. Labor shadow minister for innovation, technology and the future of work, Clare O'Neil, did not respond to requests for comment prior to publication. This was the main criticism of the idea from the likes of Giant Leap Fund venture partner Peter Cameron and Shootsta co-founder Tim Moylan. "The patent box reform would be a fantastic drawcard for larger companies looking to set up in Australia. But much like our R&D tax incentive scheme, most of the benefits would go to larger, established businesses," Mr Moylan said. "We see many businesses fall over on their way to either seed funding or Series A. This 'Patent Box' policy doesn’t address this gap. It’s a great incentive for our growth companies to keep their business in Australia, but almost all of them are already doing this," Mr Cameron added.
