In a blog post last week, Meta stopped short of immediately committing to an audit of what its Oversight Board describes as potentially “ inconsistently enforced ” policies regarding the sale or promotion of illegal and recreational drugs on its platforms. The company also ignored a separate recommendation from the Board calling on the company to clarify language in its drug-related policies. Currently, posts admitting to using or promoting pharmaceutical drugs, including those that result in a high, are only allowed in the context of a “supervised medical setting.”

But what exactly counts as a supervised medical setting in an era where startups can mail Schedule III drugs to your door? Meta, the Board wrote, needs to properly define what a medical setting means here and update its Restricted Goods and Services Community Standard accordingly. Changes to that policy potentially excluding “home use” as a proper medical setting could have dealt a blow to trendy mail-order drug companies like MindBloom by restricting users’ ability to post about ketamine, MDMA, and other psychoactive drugs being used by some clinicians to treat mental health issues. “The Board is concerned about Meta’s inconsistent enforcement of its policies with regards to pharmaceutical and non-medical drugs,” Oversight Board spokesperson Dan Chaison told Gizmodo. “It stands by its recommendation that Meta should clarify the policy language around content that admits to using or promoting pharmaceutical drugs, and audit how its Branded Content policies and its Restricted Goods and Services Standard are being enforced.”

Meta, in its response, said it is worried that implementing the Board’s recommendation could result in the “unnecessary and disproportionate” removal of potentially helpful speech online. “We are concerned that requiring users to include specific language about a ‘supervised medical setting’ to post content about these drugs that we would otherwise allow would unduly restrict speech on our platforms,” Meta said in its response. “Such a requirement could result in removal of legitimate speech by limiting people’s discussions of pharmaceutical drugs, even where there is no evidence of misuse, to instances where they provide details about a provider’s license, indicate the presence of medical staff, or discuss their medical diagnosis.”

Meta directed us to its response to the Oversight Board’s recommendations when reached for comment. Mindbloom General Counsel Michael Petegorsky, meanwhile, told Bloomberg the decision (or lack thereof) represents a “big win” for people interested in ketamine therapy and other psychedelics. How did we get here? The policy battle between Meta and its Oversight Board originates from a 2022 Instagram post  where a verified Instagram user posted 10 images as part of a post with a caption describing their experience using ketamine as a treatment for anxiety and depression. The post, which was labeled a “paid partnership,” included a prominent ketamine therapy provider tagged as a co-author. Ketamine therapy treatment was described as a “magical entry into another dimension.” Several of the images included psychedelic-style drawings. Advertisement
Three separate users reported the post which was viewed around 85,000 times. Each of those times, the content was removed and then reinstated. Eventually, the post’s author brought the matter to Meta’s attention thanks in part to their status as a “managed partner.” This special status is often offered to celebrities or businesses to provide them access to a dedicated partner manager and other privileges. Meta determined the content did not violate its policies and left it up but opted to toss the case to the Oversight Board for review because the core issue it raised “creates tension between our values of safety, voice and dignity.”
In its ruling, the Board pointed out that Meta’s Branded Content, which this post fell under, clearly prohibits the promotion of “drugs and drug-related products.” Meta reportedly admitted to the Board that not all of the content slapped with a “paid partnership” label are viewed against the Branded content policy due to limitations of human moderators’ ability to moderate at scale. “This greatly increases the risk of under-enforcement against this kind of content,” the Board wrote in its August decision. Meta’s response
Meta compiled with the Oversight Board’s binding decision and removed the initial Instagram post. The company also committed to clarifying the meaning of its “paid partnership” labels to increase transparency. Moving forward, Meta said it will provide specific instructions on tagging brand partners in “paid partnership” as well as offering information about which brand partners can approve that label. But Meta stopped short of the Oversight Board’s request to conduct a full audit of its enforcement policies as it relates to selling and paid promotion of drugs. Instead, Meta hedged and said it would “assess the feasibility” of conducting an extensive audit in the first half of 2024. It’s too early to tell whether or not that full audit will ever happen. Overall, Meta committed to implementing three of the Board’s four recommendations in the case in full or in part. “The Board will closely monitor Meta’s progress towards the recommendations from this case,” The Oversight Board spokesperson added. Diverging from Oversight Board recommendations isn’t new
Meta has a unique, some may say odd, relationship with its Oversight Board. The transparency and ethics watchdog operated independently of the company but was created and funded by Meta. The Board selectively takes on some of the trickiest content moderation dilemmas in social media, with the goal of offering up rulings on cases that can have far-reaching consequences for billions of users. The Board previously weighed in on Meta’s years-long suspension of former president Donald Trump’s account as well as heated speech debates related to abortion rights on Facebook and Instagram . The Oversight’s bylaws say Meta must agree to the Board’s binding decisions on cases. So far, during the Board’s three years of work, Meta has upheld that agreement. But in addition to those binding decisions, the Board also issues a number of non-recommendations in its rulings for each case. Here Meta has been less willing to see eye-to-eye. Meta has already rejected key recommendations proposed by its Board, including a recent plea from the Board to immediately suspend the Facebook and Instagram accounts of former Prime Minister Hun Sen . Critics of the authoritarian dictator argue he used his platform to amplify threats of violence against political opponents. But Meta declined to take action on his accounts, saying a suspension of the “would not be consistent” with its policies. Start the discussion

Is attracting and retaining top talent on the top of your worry list these days? If so, you’re not alone. In the recently released 2023 Global Leadership Forecast , Development Dimensions International (DDI) reports that attracting and retaining top talent is the number one thing keeping CEOs up at night. In today’s rapidly changing business world, leaders are always looking for a competitive advantage. Emotionally intelligent leaders have always intuitively known that improving employee experience (EX) is vital to business success. Herb Kelleher, the founder and first CEO of Southwest Airlines said, “Your employees come first. And if you treat your employees right, guess what? Your customers come back, and that makes your shareholders happy. Start with employees and the rest follows from that.”
What Kelleher understood in his gut has been shown in the research on retention and engagement. The American Psychological Association reports that very few employees would leave an organization if they felt that the leadership was fully invested in their experience, and 89% would recommend their workplace to others. Gartner research shows that high EX human-centric work environments are 3.1x more likely to see low levels of fatigue among employees and 3.8x more likely to exhibit high performance. The power of high EX also translates directly to the bottom line. Research from Salesforce found that a company could increase revenues by up to 50% by improving the employee experience. Why Is Employee Experience so important? Experiences are the foundation of every type of human relationship. What we think and how we feel about someone (family members, colleagues, neighbors, etc.) or something (airlines, sports teams, types of soap, etc.) is entirely shaped by the practical contact we have with or about that person or thing. Each touch point leaves an impression: positive, negative, or neutral. Jan Carlzon, the former CEO of SAS (Scandinavian Airline Systems), called these contacts “moments of truth.”

EX is the perceived sum of all the moments of truth your employees have with you and your company, right from the very first moment they learned of your existence. In today’s digital world of transparency, employees have incredible choices. If an employee can jump ship to work for another company for 15% higher base pay and similar benefits, then EX becomes a tremendous differentiator of value. How to Start Improving the Employee Experience
Trying to improve EX for your team may feel overwhelming. After all, EX is the sum of every “moment of truth” each employee has had with your company. That’s a lot of data points. Where should a leader start? To improve EX, consider using a strategy like the one suggested for eating an elephant: One bite at a time. It’s useful to remember that improving EX isn’t something that you directly do. It’s an outcome that results after other intentional actions that you take. To cut EX down to a more manageable size, consider IBM ’s framework that captures the five core dimensions of employee experience. These are:
Belonging – feeling part of a team, group or organization
Purpose – understanding why one’s work matters
Achievement – a sense of accomplishment in the work that is done
Happiness – the pleasant feeling arising in and around work
Vigor – the presence of energy, enthusiasm, and excitement at work
Here are examples of some practical actions that companies have been successfully using with their teams. Belonging: Intentional In-Person Gatherings
In the early days of 2020, Workleap , a Quebec-based EX software company, invested millions in a beautiful new office. Then the pandemic hit. As CEO Simon De Baene shared, “The pandemic forced us to rethink everything. We’d thought if we had the best office, with perks like an in-house barista, our employees would have a great experience. But we learned that employees don’t actually want a cool new coffee station with cold brew. They want to be surrounded by talented people who help them progress in their career, and be a part of something exciting.”
Given their people and their industry, Workleap became a ‘remote forever’ company. The leadership is focused on giving their employees the right tools, processes and policies so they show up to work passionately, and their data supports this approach. According to a recent Officevibe study, organizations with higher employee experience investments are 1.5x more likely to have a positive employee outlook. Even ordinary, incremental progress can increase people’s engagement in the work and their happiness during the workday.”
To leverage the value of incremental progress, there’s a powerful tool that I recommend that clients use with their teams: The “Wall of Wins”. The Wall of Wins serves as a central hub for people to share wins and tap into the power of achievement. The concept is quite simple: Whether it’s physical or digital, create a dedicated space where each team member can post ‘wins’ on the wall. The wins can be big or small, personal or professional. Invite others to offer comments on the wins. The process of posting and sharing wins is a catalyst for the positive energy that comes from affirming achievements. This creates a multiplying contagion of celebration that energizes and improves the overall experience of work. Happiness: Flexible Work Schedule
Olgam Life operates a number of community-based plasma donation centers. Aliza Naiman, marketing manager, shares, “Olgam implemented a flexible work schedule policy that allows employees to better balance their work and personal lives. This change has led to increased happiness, as employees can adapt their schedules to fit their needs. I've received emails from team members expressing their gratitude for this policy, citing it as a key factor in their happiness at Olgam Life.”
Vigor: Improve Meeting Hygiene
For many employees, the biggest drain on their energy are poor meetings. A recent survey from the video app company mmhmm reported that that 45% of American workers say their meetings are too long. Nearly half (47%) of workers say that more than half the meetings they attend could be canceled, and a quarter (25%) say more than half of their meetings are useless. Dylan Beynon shares, “At Mindbloom, we keep our team energized by doing away with almost all regular meetings – most employees only have one or two per week. Employees work where they want and when they want, and instead of scheduling meetings they communicate asynchronously through shared documents and email. We have a core value of Focus: Do less, better. Practice deep work. Say no often. Constant meetings destroy focus and increase stress, and our internal research shows that employees love the meeting-free structure because it allows them to get into flow with their most important work, without constant demands and distractions.”
When you decide you’re ready to start improving EX, begin by focusing your attention on one dimension at a time. Take stock of the current state of that dimension for your team. (Asking the team for their feedback on each dimension is strongly suggested.) For example, what’s working well to increase belonging? What could make it even better? Next, take some practical actions to improve this dimension of EX for your team. If it’s working, keep doing it. If not, try something different. Chris Gathman, 40, has lived with chronic depression, a condition that runs in his family, for most of his life. He’s used a combination of antidepressants and cognitive behavioral therapy to treat his symptoms, with limited success. In 2018, he sunk into an even deeper depression that began impacting his ability to socialize and complete daily tasks. “I knew I needed to do something,” said Mr. Gathman, who lives in Miami. So when his primary care physician suggested ketamine — an anesthetic that has improved symptoms of depression in early studies — he reached out to a clinic nearby. “I woke up the next day and felt completely normal,” he said about his first IV infusion, administered at Ketamine Health Centers . “I didn’t feel depressed at all.” Mr. Gathman then persuaded his parents to seek out the therapy at the same clinic for their depression, and they both reported immediate relief as well. Ketamine — an anesthetic first popular with the 1970s counterculture movement and then as a club drug known as “Special K” — has recently emerged as a promising mental health treatment. Unlike conventional antidepressants, which work by increasing serotonin levels, ketamine appears to impact on a neurotransmitter called glutamate , which is thought to play a role in regulating mood. Thanks to these success stories, hundreds of new ketamine providers have popped up across the country. Typically patients take ketamine through an IV, nasal spray or tablet once or twice a week for six to eight weeks (though some may need to take it longer). Sessions last between one and two hours and can cause feelings of dissociation, or feeling disconnected from reality, and euphoria. Mr. Gathman, for instance, said the treatment made him “sleepy” and provoked an “out of body” experience. He described these sensations as “pleasant” — though he struggled with his balance and a sense of being “dazed” for several hours following each session. The ketamine boom has increased access to thousands who may benefit, but some scientists and doctors worry the drug is not yet ready for widespread use. Image

“I understand the rush for ketamine, in both private and public clinics,” said Dr. Carolyn Rodriguez, director of the Translational Therapeutics Lab at Stanford University, who conducted an early small trial of ketamine to treat obsessive compulsive disorder and saw an impressive and immediate decrease in symptoms. But given the lack of long-term data, potential for troubling side effects and possibility for abuse, “I believe that ketamine is not yet ready for safe general use,” she said. Ketamine on Demand
Ketamine’s success in early trials has surprised and excited researchers who study mood disorders, a field where drugs like Prozac and Zoloft, paired with talk therapy, have been the main treatment options for decades. But, as with Mr. Gathman, interventions don’t work for up to 30 percent of those suffering from major depression. Moreover, it can take up to two months to determine whether these interventions have any effect at all — a dangerously long time for those suffering from suicidal thoughts and other mood disorders , said Dr. Joshua Berman, the medical director for interventional psychiatry at Columbia University, who helps lead the development of the department’s ketamine program. Ketamine’s effects, on the other hand, are often immediate. Though relatively new in the field of mental health, ketamine has been used in hospitals and on battlefields as an anesthetic since 1970. While the drug’s clearance by the Food and Drug Administration does not yet extend most ketamine treatments to mood disorders, any physician can prescribe it off-label to patients whom they believe might benefit — allowing the commercial ketamine business to flourish. Chris Walden, the co-founder of Ketamine Media , a public relations firm that works with ketamine providers, said that ketamine clinics have grown from a few dozen to “many hundreds,” in the United States but couldn’t give exact numbers. Some of these providers are associated with academic institutions conducting clinical trials. Others operate out of private boutique-like clinics such as Nushama , which was recently opened on Park Avenue in New York City by designer Jay Godfrey. And some patients skip the clinic entirely. Mindbloom , which launched in late 2018, is an at-home delivery service that sends ketamine lozenges directly to the homes of patients. The company — among the fastest growing of several at-home ketamine delivery services, like My Ketamine Home and TrippSitter — pairs its clients with psychiatric clinicians certified to prescribe drugs, who determine if the drug is appropriate for them. Then other employees, called “psychedelic guides,” meet with patients virtually before and after sessions to process the experience. There are no formal requirements to becoming a psychedelic guide, but most have completed training in fields such as mental health, life coaching or crisis management. Dylan Beynon, Mindbloom’s chief executive and founder, said over 80 percent of his clients suffering from depression or anxiety experience significant improvement after four sessions — and that just 5 percent of patients experience side effects, which were mostly mild. By shipping directly to clients, the company has lowered the cost of ketamine therapy — which averages $400 to $800 per session at many in-person clinics — to $120 to $190 per session, said Mr. Beynon. Given that ketamine is rarely covered by insurance, this is still prohibitively expensive for many. Still, many experts do not believe patients should be self-administering ketamine — which can produce powerful dissociative sensations and even a seemingly catatonic state — outside of a clinical setting. Other side effects — like increased blood pressure, paranoia and suicidal thoughts — are rare and typically only appear at very high doses . Dr. Leonardo Vando, Mindbloom’s medical director, claimed that out of tens of thousands of doses administered, the company has only observed mild side effects, like nausea. Dr. Gerard Sanacora, director of the Yale Depression Research Program and the Yale-New Haven Hospital Interventional Psychiatry Service, agreed that serious side effects are rare but has seen patients experience chest pains and worried about exacerbating heart conditions. “If you treat enough people, something is going to go wrong,” he said. “With a drug like ketamine that can affect heart rate and blood pressure, it’s especially important to get a well-documented cardiac history, laboratory screening assessments, and to be monitored during the infusions,” said Dr. Rodriguez. Screening candidates in this way led her to discover an undiagnosed heart condition in one patient. “It would not have been a good idea to give ketamine to that person.”

A Promising Yet Unregulated Industry
Many ketamine providers, including Mindbloom, require clients to meet with a psychiatric clinician to ensure they are a good fit for the therapy. Mr. Beynon said his company, which conducts these screenings remotely, turns away roughly 35 percent of those that apply — including people whose symptoms aren’t severe enough to warrant it or are too severe for at-home treatment. He declined to provide documentation to support this claim. However, this level of screening is not required by law and some patients just find a prescribing doctor online who will issue the drug through a private pharmacy with no other oversight. The potential for abuse is reason to be cautious about ketamine’s use outside of a carefully controlled clinical setting, said Dr. Rodriguez — particularly in clinics that may be providing higher doses than what has been studied. “There is potentially this opioid effect , this rush, that taps into brain regions that may be susceptible to addiction,” she said. Ketamine’s impacts can also be transient, Dr. Berman said, meaning some patients may need to keep taking it — but most research has not looked at the long-term effects of ketamine therapy. There is one exception. In 2019 the Food and Drug Administration approved esketamine, a ketamine nasal spray, for the treatment of drug-resistant depression and suicidality. This approval was given only after large, randomized, placebo-controlled trials, said Dr. Sanacora. This research also led to the creation of strict guidelines for use of the product — like conducting the therapy in a certified doctor’s office or clinic and monitoring a patient for two hours after treatment. “I am not sure why the same evaluation and management guidance isn’t being used for other forms of the treatment,” Dr. Sanacora said. Dr. Rodriguez said she believed ketamine providers should be relying on a 2017 Consensus Statement issued by an American Psychiatric Association task force, of which both she and Dr. Sanacora are members. The statement includes best practices for screening potential patients and for administering the drug — some of which would be difficult outside of a well-equipped clinical setting. Waiting For Data
Most experts agree much more research about ketamine’s effectiveness in mental health is needed, and dozens of trials are currently underway globally. However, there are real barriers to new large-scale trials like those conducted with esketamine, said Dr. Berman, since pharmaceutical companies are unlikely to pay for research into a drug that can already be prescribed off label. “The nasal spray was new technology so there was a greater incentive for the private sector to invest in large trials,” he said. In the absence of this research, Dr. Sanacora and others have suggested the creation of a registry — similar to the Risk Evaluation and Mitigation Strategy program, which the F.D.A. requires for certain medications with serious safety concerns — to help gather data on side effects and how the drug is being administered. Some researchers believe this type of data, once gathered, could be used to develop better standards in the industry — and could even expand ketamine’s use, rather than restrict it. For instance, though ketamine has mostly been studied in drug-resistant patients, some believe it could prove to be an effective first-line treatment option for severe depression, said Dr. Berman, since its impacts are often felt immediately. While more data is collected, Dr. Rodriguez said that plenty of patients are truly suffering. “They’re in such deep, deep pain,” she said. “As long as patients understand the limits of current research and are able to make an informed decision with their clinical care team, shouldn’t they be allowed to weigh potential side effects against the deep pain that they’re in?”
