Petition made to wind up Mervyn Smith-owned Beneavin Contractors

Dublin company Principal Construction has petitioned the High Court to wind up a firm owned by businessman Mervyn Smith, who sold his FirstCare nursing home business to French firm Orpea last year for more than €100m. Last year, the High Court enforced an adjudicator’s decision in a dispute over payment originally totalling €1m that Principal Construction said it was owed from Mr Smith’s Beneavin Contractors in relation to a nursing home project. The adjudicator had awarded Principal Construction more than €643,000 in the case. Principal Construction has now petitioned the High Court to have Beneavin Contractors wound up. The petition is due to be heard on November 7. Principal Construction, which was founded in 1999, is controlled by Niall Daly and Peter Mahon. It has worked on a wide variety of projects In 2017, Principal Construction was invited to tender for the construction and the extension of the Beneavin Lodge Nursing Home in Dublin. But the company’s tender was not successful and the project was awarded to Sammon Contracting. However, in April 2018, Sammon Contracting went into examinership and the construction work on the nursing home project were only 40pc complete. Talks then took place with Beneavin’s contract administrator, OKP, with a view to Principal Construction taking over the project. A contract was executed in November 2018. In 2019, Principal Construction submitted a final account for the sum of just over €1m, which included almost €914,000 in a claim for variations. OKP did not accept the sum being claimed by Principal Construction. In early December 2019, OKP issued a final certificate notice summary where it recommended a payment of just over €31,000 to Principal Construction. Later that month, OKP issued a final certificate payment recommendation stating that the Principal Construction was not due any payment, but that in fact Beneavin Contractors was due €116,309 from the building firm. In June 2020, Principal Construction issued a notice of adjudication, In August that year, the adjudicator issued a decision awarding the firm €643,635 against Beneavin Contractors. Principal Construction subsequently began High Court proceedings seeking to have the adjudication award enforced. But Beneavin Contractors objected to that, arguing a number of points including that the adjudicator’s refusal to permit Beneavin to prosecute its counterclaim “was made in material breach of natural justice”.
