FTC gets green light to move against Digicel merger

17 May 2012 Jamaica Jamaica’s Fair Trade Commission (FTC) has been given the green light to challenge the controversial merger of Digicel Jamaica and America Movil’s (AM’s) Claro Jamaica, nearly nine months after the deal was given approval by the prime minister’s office. According to local news reports, earlier this week the Kingston Supreme Court threw out a petition from Digicel challenging the FTC’s authority to challenge the acquisition clearing the path for the FTC to take action against the tie-up. It is as yet unclear, however, what effect this will have on the sector as the FTC would be unable to halt the acquisition; AM has long since shut up shop in Jamaica, its network was closed down in March and former subscribers urged to move to Digicel. As previously noted by CommsUpdate, the FTC first brought a lawsuit against Digicel in January this year, with the pan-Caribbean operator criticising the litigation as an attempt to ‘squeeze merger regulation through the back door.’
